Privacy Policy

Archi's Inc. DBA TeamCraft, a Delaware corporation doing business as TeamCraft (“TeamCraft,” “we,” “us,” or “our”), is committed to protecting your privacy. This Privacy Policy explains what personal data we collect, how we use and disclose it, and the choices and rights available to you when you visit our website or use the TeamCraft platform (together, the “Offerings”). Terms such as “Candidate,” “Business Customer,” and “AI Features” have the same meaning here as in our Terms of Service.

If you do not agree with this Privacy Policy, you should not access or use our Offerings.

1. Who This Policy Covers, and Your Role

How we collect and use your data depends on your relationship to TeamCraft. You may interact with us as:

• Visitor — someone browsing our website without an account;

• Business Customer User — an employee or representative of an employer, university, or technopark using the Service under a Business Customer’s account; or

• Candidate — someone invited by a Business Customer to complete a hackathon-style assessment or other Candidate Feature.

Where you use the Service as a Candidate or Business Customer User, the Business Customer that invited or authorized your access is the party that determines how and why your data is processed for its assessment and hiring purposes. As described in Section 8 below, this affects how you exercise certain privacy rights.

2. Information We Collect

2.1 Information You Provide
We collect information you provide directly, including your name, email address, phone number, username, and organization details when you register, fill out forms, or contact us. If you are a Candidate, we also collect the code, responses, written or audio/visual content, and other material you submit while completing an assessment (“Submissions”), together with the results, scores, and rankings generated from your participation (“Results”).

2.2 Information Collected Automatically
We automatically collect certain technical information when you use the Offerings, including your IP address, browser type and version, device information, pages visited, features used, and interaction data. We use cookies and similar technologies to collect some of this information, as described in Section 3.

2.3 Information From Business Customers
If you are a Candidate or Business Customer User, we collect data that the Business Customer provides to us about you, such as your contact information and the details of your invitation to participate in an assessment. Contact the relevant Business Customer for more information about what it provides to us.

2.4 Assessment and AI-Related Data
If a Business Customer enables AI Features for an assessment, we may collect and process, in addition to your Submissions and Results: keystroke and session activity, timing and interaction patterns, and — only where a specific assessment feature requires it and you separately consent — webcam images or facial data for identity or integrity verification. We do not collect facial or biometric data unless the Business Customer has enabled that specific functionality and you have provided your consent.

2.5 Information From Third Parties
We may receive information about you from third parties, such as identity verification providers, analytics providers, or integrations a Business Customer connects to the Service (for example, an applicant tracking system).

3. Cookies and Tracking Technologies

We use cookies and similar tracking technologies on our website to authenticate you, keep the Service secure, understand how the Offerings are used, and, where applicable, support marketing efforts. We use the following categories:

• Essential Cookies — required for login, authentication, security, and locale preferences. These cannot be disabled without affecting core functionality.

• Analytics Cookies — help us understand usage patterns so we can improve the Service.

• Session Cookies — maintain your session state while you are using the Service.

We do not currently use third-party advertising or cross-context behavioral tracking cookies. If this changes, we will update this Policy and provide any opt-out mechanism required by law. You can control cookies through your browser settings; note that blocking essential cookies may prevent parts of the Service from functioning. Our website does not currently respond to browser “Do Not Track” signals.

4. How We Use Your Information

We use the information we collect to:

• provide, maintain, secure, and improve the Service;

• deliver assessment Results and related analysis to the Business Customer that invited you;

• communicate with you about your account, inquiries, or the Service;

• send marketing communications, where you have consented or as otherwise permitted by law;

• detect, investigate, and prevent fraud, abuse, or violations of our Terms of Service, including integrity issues during an assessment;

• develop and improve our AI Features, using de-identified or aggregated data only, consistent with our Terms of Service; and

• comply with our legal obligations.

5. Automated Processing and AI Features

5.1 Employer-Enabled
Our AI Features are only active for a given assessment if the Business Customer enables them. AI Features may analyze your Submissions to assess skills, code quality, or collaboration patterns, or to flag potential integrity concerns (such as signs of unauthorized assistance). The resulting Output is provided to the Business Customer, which retains full discretion over how to interpret or act on it — TeamCraft does not make hiring, admissions, or other decisions about you.

5.2 Consent for Sensitive Processing
Where an assessment uses facial image collection, biometric matching, or other sensitive processing, we will provide notice and request your consent before you participate. If you do not consent, you may be unable to participate in that specific feature, and should contact the inviting Business Customer about alternative options.

5.3 Model Training
We do not use your individually identifiable personal data to train TeamCraft’s AI models. Where we use assessment data to improve our AI Features, we use only de-identified or aggregated data, consistent with the license described in our Terms of Service.

5.4 Right Not to Be Subject to Solely Automated Decisions
You have the right not to be subject to a decision based solely on automated processing that produces a legal or similarly significant effect on you, without appropriate safeguards. Because Business Customers — not TeamCraft — make the ultimate hiring or evaluation decision, this right is generally exercised with the Business Customer; contact us at [email protected] if you have questions about how a specific AI Feature was used.

6. How We Disclose Your Information

We do not sell your personal information, and we do not share it for cross-context behavioral advertising purposes. We may disclose your information to:

• Business Customers — if you are a Candidate or Business Customer User, we disclose your Submissions, Results, and related data to the Business Customer that invited or authorized your use of the Service;

• Service Providers — vendors who help us operate the Service, such as hosting, analytics, email delivery, and payment processing providers, acting under confidentiality and data protection obligations;

• Integrations — third-party tools a Business Customer connects to the Service (e.g., an applicant tracking system), as directed by that Business Customer;

• Legal and Compliance — law enforcement, regulators, or other third parties where required by law, or as necessary to protect the rights, property, or safety of TeamCraft, our users, or others;

• Business Transfers — a prospective buyer or successor entity in connection with a merger, acquisition, or sale of assets, subject to protections at least as protective as this Policy; and

• Affiliates — our corporate affiliates, consistent with this Policy.

If, in the future, we intend to sell or share personal information as defined under the CCPA, we will provide notice and a means to opt out before doing so.

7. International Data Transfers

TeamCraft is based in the United States, and our Offerings are operated from and hosted in the United States. We also work with personnel and partners in Türkiye. If you access the Service from outside the United States, your information will be transferred to, stored, and processed in the United States and potentially other countries where we or our service providers operate. Where required by applicable law (such as the GDPR), we use appropriate safeguards, such as Standard Contractual Clauses, for these transfers.

8. Your Privacy Rights

8.1 If You Are a Candidate or Business Customer User
Where we process your data on behalf of a Business Customer, that Business Customer is generally the controller (or “business,” under the CCPA) responsible for your data, and TeamCraft acts as processor (or “service provider”) under our agreement with them. To exercise rights in your data in this context, please contact the relevant Business Customer directly; we will follow their instructions regarding your data. You may also contact us at [email protected] and we will direct your request appropriately or assist as our agreement with the Business Customer allows.

8.2 European Economic Area, UK, and Similar Jurisdictions (GDPR)
Where TeamCraft acts as controller of your data (for example, as a Visitor to our website), you have the right to: access your data; rectify inaccurate data; request erasure in certain circumstances; restrict our processing; receive a copy of your data in a portable format; object to processing based on our legitimate interests, including for marketing; and lodge a complaint with your local data protection supervisory authority. We process your data based on one or more of the following legal bases: performance of a contract with you or a Business Customer, our legitimate interests (such as securing and improving the Service), your consent, or compliance with a legal obligation.

8.3 California and Other U.S. States (CCPA and Similar Laws)
If TeamCraft is the “business” with respect to your data (i.e., you are not using the Service as a Candidate or Business Customer User), you have the right to: request access to and a copy of the personal information we hold about you; request correction of inaccurate information; request deletion of your information, subject to certain legal exceptions; opt out of the sale or sharing of your personal information (we do not currently engage in either); limit the use of any Sensitive Personal Information we collect to what is reasonably necessary to provide the Service; and not be discriminated against for exercising these rights. Residents of other U.S. states with applicable privacy laws (e.g., Virginia, Colorado, Utah, Connecticut) have similar rights under their respective laws.

8.4 Exercising Your Rights
To exercise your rights described in Section 8.2 or 8.3, contact us at [email protected] or by mail at Archi's Inc. DBA TeamCraft, 400 W Emmett St, Kissimmee, FL 34741. We will respond within one (1) month for GDPR requests, forty-five (45) days for CCPA requests, or within the time period required by applicable law, and may extend that period where permitted, in which case we will notify you of the reason and extension. We may need to verify your identity before completing your request. Please note that deleting or restricting the processing of your data may limit or prevent your ability to use parts of the Service that depend on that data.

9. Data Retention

We retain your personal information for as long as your account is active, for as long as needed to provide the Service, or as required by our agreement with the applicable Business Customer, whichever is longer, unless a shorter or longer period is required by applicable law. When retention is no longer necessary, we securely delete or anonymize your information.

10. Data Security

We implement administrative, technical, and physical safeguards designed to protect your information, including encryption in transit and at rest, access controls, and regular security review. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

11. Third-Party Services

The Service may integrate with third-party services, such as GitHub, Google Analytics, and Mailgun, and Business Customers may connect additional integrations (such as applicant tracking systems). These third parties have their own privacy policies governing their use of your information, and we encourage you to review them. A list of our current sub-processors is available upon request to [email protected].

12. Children’s Privacy

The Service is not directed to individuals under the age of 16, and we do not knowingly collect personal information from children under that age. If we learn that we have collected personal information from a child under 16, we will delete it as soon as reasonably possible.

13. Governing Law

This Privacy Policy is governed by the laws of the State of Delaware, without regard to its conflict-of-law principles. Any disputes arising from this Policy will be resolved exclusively in the courts of Delaware, except where applicable law provides otherwise.

14. Changes to This Policy

We may update this Privacy Policy from time to time. If we make a material change, we will notify you by posting the updated Policy on this page with a revised “Last Updated” date, or by other reasonable means. Please check back periodically for updates.
